Terms and General Conditions of the AllGarfo Portals

1. AllGarfo Portals
1.1. The Portals of the AllGarfo Network are open and comprehensive guides to restaurants and wines, where everybody can put their comments and ratings, and not just one restrict group of people, being a service provided by WladiVal - Tourism & e-Business Lda (hereinafter only called WladiVal Lda) through several URL's, aimed at providing a set of their own services, with public and private functions.
1.2. These General Terms apply to all Portals of the AllGarfo Network , there may be, Special Conditions for certain services provided through the Portals.

2. Terms of Access to Portals
2.1. Access to the portals mentioned in section 1.1. is open to individual users (individuals) and business users (corporate).
2.2. The application form to join the portals mentioned in section 1.1. is made by filling the registration form, and reading and accepting the provisions of these General Terms by the user.
2.3. In the online application for membership every user must provide: (i) their e-mail address (email); (ii) their mobile phone number (mobile); and (iii) their zip code (CEP).
2.4. The User and/or Customer takes full responsibility for the truthfulness, accuracy, validity and authenticity of data provided in the application for access to the portals mentioned in section 1.1 ..
2.5. After filling out the membership application by the user and acceptance of these General Terms, the application for membership is confirmed by the portal by sending an email to the user with the information necessary to activate their registration.

3. Codes
3.1. In the application for access to the portals mentioned in section 1.1., the user must choose a User ID and Access Code (Password) that guarantee the legitimacy and confidentiality of access.
3.2. The User ID and Access Code are personal, not transferable, for information and exclusive use by the user, so this should ensure and protect in all circumstances the confidentiality thereof and is liable to WladiVal Lda and third parties for any damage resulting from abusive use thereof.

4. Price, Invoicing and Payments
4.1. The use of the portals mentioned in section 1.1. is free for individual users (individuals).
4.2. The use of the portals mentioned in section 1.1. by business users (corporate) is free for Garfo Bronze members and has costs for Garfo Prata and Garfo Ouro members (see prices on the menu "Advertise on AllGarfo").

5. Suspension of Service
5.1. WladiVal Lda reserves the right to suspend or terminate access to the portals mentioned in section 1.1. as well as ask for confirmation of any information provided by the user.
5.2. WladiVal Lda may suspend access to the portals mentioned in section 1.1. if the user does not use the service for a period exceeding 12 months.
5.3. If access to the services is suspended the user may make new application for access, acting as provided in clause 2 above.

6. Responsibility
6.1. The portals mentioned in section 1.1. have adequate levels of security, yet WladiVal Lda shall not be liable for any damages suffered by the user and/or third parties, which are due to: Delays, interruptions, errors or suspensions of communications that are based on factors beyond its control, including any shortcomings or failures caused by the communications network or services provided by third parties, via the computer system, the modems, the connection software or any computer viruses.
6.2. Any biased activities in the portals mentioned in section 1.1. by individual users (individuals) and/or business users (corporate) or third party users are subject to severe and lasting punishment. We strongly recommend that owners/managers of businesses do not try to write their own comments. Visit the page of the owner of the establishment to see how you can submit information about their establishment and/or wine on our site and respond to comments left by users. If you want to share with us any irregularities or wrongdoing without penalty or wish to report a concern about a comment attached to your establishment, please contact us.
6.3. The tolerance by WladiVal Lda for false comments is zero! We consider all fraudulent comments very seriously and invest a large proportion of our resources and energy to ensure the integrity of our content. On the rare occasion that we detected a biased comment, we follow these steps:
a) We remove the comment from the portals mentioned in section 1.1.
b) We accompany the establishment target of the false comment on possible further attempts to manipulate their ranking.
c) We penalize the establishment in our popularity rating and warn our users of their actions.
6.4. The comments that appear on our site must comply with our guidelines for submission. All comments from users of the portals mentioned in section 1.1. represent the subjective opinion of that user, and never of WladiVal Lda. 6.5. The data and information search as well as service requests, made within the portals mentioned in section 1.1. shall be deemed made by the user, WladiVal Lda declining any liability arising from any misuse or fraudulent use of information obtained.
6.6. The materials and information transmitted and commissioning services requested by the user to the portals mentioned in section 1.1. shall enjoy full legal effect, the user not being able to plead lack of signature for breach of undertaken obligations.

7. Personal Data
7.1. User data collected under the access to the portals mentioned in section 1.1. are processed automatically and are mandatory, indispensable for our services; the omission or inaccuracy of the data provided by user is their sole responsibility.
7.2. Being the Internet by nature an unsafe environment, the data on the network can be viewed and used by others.
7.3. In accordance with and authorized by the acceptance of the access to the portals mentioned in section 1.1. the user's personal data contained therein in accordance with applicable law, will be processed and stored by computer and are intended to be used by WladiVal Lda under the contractual relationship with the user and for the marketing of its services and/or products; this data can be used in accordance with the conditions accepted by the User.
7.4. Under the applicable legislation, it is guaranteed to individual users (individuals) and business users (corporate), without additional charge, the right to access, correct or update their information, directly or through written request and the right to object to their use for the purposes of the paragraph above, contacting therefore the entity responsible for processing the data.

8. Communications and Notifications
The Client agrees to receive any communication and/or notification relating to the portals mentioned in section 1.1. at the address and or e-mail indicated in the Application Form.

9. Changes
9.1. WladiVal Lda reserves the right to amend these General Terms.
9.2. Any changes to the General Terms will apply as long as reported to the User, by any appropriate means, with at least 15 (fifteen) days before the date of its entry into force.
9.3. In the case of non-acceptance of the changes, the Customer may terminate this agreement with at least 8 (eight) days before the date of entry into force of amendments.
9.4. The termination referred to in the preceding paragraph shall become effective on the date of entry into force of amendments to these conditions.
9.5. Termination of the contract pursuant to the preceding paragraphs does not amount to the right to compensation for damages or other compensation.

10. Termination
10.1. Either party may terminate the contract in case of default or defective performance of any obligations undertaken by this contract.
10.2. The termination referred to above operates eight (8) days after receipt of written notification sent by one Party to the other, citing the reasons and amounts to the immediate termination of any rights and obligations, except to possible compensations to which either party might be entitled.

11. Term
The portals mentioned in section 1.1. offer a service for an indefinite period, ceasing by simple communication by WladiVal Lda to the user sent with at least 15 (fifteen) days before the date of termination.

12. Law and Jurisdiction
12.1. To all the questions that are not covered by these conditions apply the Law of the Portuguese Republic.
12.2. In case of dispute, in the interpretation or application of these conditions, the court of the district of Lisbon has jurisdiction, with express waiver of any other.

13. Property
The portals mentioned in section 1.1., are registered sites and the service provided by them is the responsibility of WladiVal - Tourism & e-Business Lda, headquartered at Rua da Barca, s/n, 2240-611 Dornes, Ferreira do Zêzere, (legal) collective person  with the number: 507 138 759 (CNPJ) of the Portuguese Republic.
